1. Agreement
These Terms of Service ("Terms") are an agreement between you and MakeMeme ("we", "us"), which operates the website makememe.video and related services (the "Service"). By creating an account, buying credits or using the Service, you accept these Terms and our Privacy Policy. If you don't agree, don't use the Service.
2. Who can use MakeMeme
Adults only.
You must be at least 18 years old and able to form a binding contract. The Service is not directed to children, and we delete accounts we learn belong to anyone under 18.
3. Your account
- You sign in with Google or with a one-time link sent to your email.
- Keep access to your email account secure. You are responsible for activity on your account.
- Tell us at [email protected] if you think someone else has used your account.
- One person per account. Don't create multiple accounts to get around limits.
4. Credits, plans and payments
You buy credits; each trend lists its credit cost before you generate.
Credits
- Each video costs the number of credits shown on its trend page before you press Generate.
- Credits are deducted when a generation starts and returned automatically if it fails.
- Credits have no cash value, cannot be transferred or sold, and are not redeemable for money.
- Credits from one-time packs do not expire while your account is open.
- Credits included in a subscription are added at the start of each billing period and expire at the end of that period.
Subscriptions
- Subscriptions renew automatically each month or year until you cancel.
- You can cancel anytime from your account's billing page. Cancellation takes effect at the end of the current period, and you keep that period's credits until then.
- We may change prices. For subscriptions, we'll email you at least 14 days before a price change takes effect, and you can cancel before it does.
Payments
Payments are processed by Stripe. We don't see or store your full card number. Prices are shown in U.S. dollars and may exclude taxes, which are added at checkout where required.
5. Refunds
Unused credits can be refunded within 7 days; used credits can't. Failed videos are refunded in credits automatically.
- Failed generations: you're never charged for a video that fails. If a generation errors, times out or is blocked by our safety checks, its credits go back to your balance automatically, with no need to contact us.
- Credit packs: within 7 days of buying a pack you can ask for a refund of its unused credits, valued at that pack's price per credit. A pack you haven't touched is refunded in full; for example, if you bought 300 credits for $27 and used 100 of them, we refund $18. Credits already used are not refundable.
- Subscriptions: your first payment, or a renewal, can be refunded in full within 7 days of the charge if you haven't used any of the credits it added. Once you've used some of them, that payment is final. We don't refund part of a billing period. You can cancel anytime to stop future renewals, and your credits stay available until the end of the period you paid for.
- After 7 days, and for credits already spent on a finished video, purchases are final.
- How to ask: email [email protected] from your account's email address with your receipt or order number and the reason. Approved refunds go back to your original payment method through Stripe, usually within 5–10 business days, and the refunded credits are removed from your balance.
- Billing mistakes: if you were charged twice or charged the wrong amount, tell us within 30 days and we'll fix it.
- Chargebacks: please contact us before disputing a charge with your bank; we usually sort things out within 5 business days. A chargeback for credits you've already used may lead to your account being suspended.
- Quality issues: if a video is clearly broken (for example, frozen, corrupted or with no person in it), email [email protected] within 7 days with the video link and we'll return the credits.
- AI results vary. A video not matching your taste is not by itself a reason for a refund.
- Nothing in these Terms limits any refund rights you have under your local consumer law.
6. Your uploads
You keep ownership; you give us permission to process uploads only to make your video.
You keep all rights in the photos and text you upload ("Uploads"). You grant us a limited, worldwide, non-exclusive, royalty-free licence to store, process and transmit your Uploads only as needed to generate your videos, operate and secure the Service, and comply with law. This includes sending them to the AI providers listed in our Privacy Policy.
We do not use your Uploads or videos to train AI models, and we only send them to AI providers through business APIs whose terms do not allow using them for model training. Uploads are deleted automatically after 7 days.
You confirm that you have the rights and permissions needed for every Upload, including the consent of every person who appears in it.
7. Acceptable use
Only real consent, only adults, nothing sexual, hateful or deceptive.
You may not use the Service to create, upload or share content that:
- shows a person who has not agreed to it. Only upload yourself, or adults who have given you permission;
- shows or appears to show anyone under 18;
- depicts celebrities, politicians or other public figures, or impersonates any real person;
- is sexual, nude or sexually suggestive;
- harasses, bullies, threatens, humiliates or defames anyone;
- promotes hate, violence against real people, self-harm or illegal activity;
- is meant to deceive, such as fake news, scams, election misinformation, or passing the video off as real footage of an event that didn't happen;
- infringes anyone's copyright, trademark, privacy or publicity rights.
You also may not:
- try to bypass our safety filters, limits or payment systems;
- scrape, reverse-engineer or overload the Service, or access it by automated means without our written permission;
- resell the Service or generated videos as a competing product.
We use automated checks and, where needed, human review to enforce these rules. We may block a generation, remove content and suspend accounts that break them, and we report child sexual abuse material to the relevant authorities.
8. Generated videos
Yours to use — responsibly.
- As between you and us, you own the videos and images generated for you ("Outputs"), to the extent the law allows. We assign to you any rights we have in them.
- You grant us a licence to host and deliver your Outputs to you, and to keep them as needed for safety, legal compliance and abuse investigations.
- We will not use your Outputs in our marketing without your separate, explicit permission.
- Outputs are deleted automatically after 7 days. Download anything you want to keep.
- AI-generated content may not be protected by copyright in some countries, and similar Outputs may be generated for other users.
- When you post an Output, follow each platform's rules on labelling AI-generated or altered content. Our files may include metadata that identifies them as AI-generated; don't remove it to mislead people.
9. How the AI works
Results are generated, not filmed, and can be imperfect.
Videos are made by third-party generative AI models selected per trend (for example models from ByteDance, MiniMax, Google and Kuaishou). Results are probabilistic: the same photo can produce different videos, likeness may not be exact, and occasional artefacts happen. We may change the model used for a trend at any time to improve quality or reliability.
10. Trends, brands and music
We name trends so you can find them; we're not affiliated with the brands in them.
Trend names on MakeMeme describe what people search for and talk about on social media. When a trend refers to a film, character, brand or song, we are not affiliated with or endorsed by its owner, and all trademarks belong to their owners. We generate original scenes inspired by trend formats and do not include copyrighted songs in Outputs. If you add music when posting, make sure you have the right to use it, for example through the platform's licensed sound library.

11. Our property
The Service, including its software, design, text, trend pages and branding, belongs to MakeMeme and its licensors. These Terms don't give you any rights to it except the right to use the Service as described here.
12. Suspension and termination
You can close your account anytime by emailing [email protected]. We may suspend or close your account if you break these Terms, if required by law, or to protect users or the Service. If we close your account without cause, we'll refund unused paid credits. If we close it because you broke these Terms, unused credits are forfeited.
13. Disclaimers
The Service is provided "as is" and "as available". To the extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We don't guarantee that the Service will be uninterrupted or error-free, or that any video will go viral.
14. Limitation of liability
To the extent the law allows, MakeMeme will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim and US$50. Some jurisdictions don't allow these limits, so they may not apply to you.
15. Indemnity
You agree to defend and indemnify MakeMeme against claims, losses and costs (including reasonable legal fees) arising from your Uploads, your use of Outputs, or your breach of these Terms, including claims by people who appear in your Uploads.
16. Governing law and disputes
Before filing a claim, please contact us at [email protected] so we can try to resolve it informally within 30 days. If you are a consumer, you also keep any mandatory protections and rights to sue that your local law gives you.
17. Changes to these terms
We may update these Terms as the Service changes. We'll post the new version here with a new effective date and note it in the version history below. For material changes, we'll also email account holders at least 14 days before they take effect. Continuing to use the Service after that means you accept the updated Terms.
18. General
These Terms and the policies they link to are the entire agreement between you and us about the Service. If any part is unenforceable, the rest stays in effect. Our not enforcing a provision is not a waiver. You may not transfer these Terms; we may transfer them as part of a merger, acquisition or sale of assets.
