1. Overview
MakeMeme respects intellectual property and people's control over their own image. We respond to notices of alleged copyright infringement under the U.S. Digital Millennium Copyright Act (17 U.S.C. § 512) and to other rights complaints described below. Our Terms of Service prohibit uploading content you don't have the rights to, and making videos of people without their consent.
2. Copyright notices (DMCA)
To report material on MakeMeme that you believe infringes your copyright, send a notice that includes:
- your physical or electronic signature;
- a description of the copyrighted work you say is infringed;
- the URL or other information that lets us find the material on makememe.video;
- your name, postal address, telephone number and email address;
- a statement that you have a good-faith belief that the use is not authorised by the copyright owner, its agent or the law;
- a statement that the information in the notice is accurate and, under penalty of perjury, that you are the copyright owner or authorised to act on the owner's behalf.
Notices that leave out these elements may not be acted on.
3. Designated agent
Send copyright notices and counter-notices to our designated agent:
| Agent | MakeMeme Copyright Team |
|---|---|
| [email protected] |
Email is fastest. Only copyright and rights notices go to this address; for anything else, write to [email protected].
4. Counter-notices
If your content was removed by mistake, you can ask for it back.
If we removed your content because of a copyright notice and you believe that was a mistake or misidentification, you can send our agent a counter-notice that includes:
- your physical or electronic signature;
- a description of the material removed and where it appeared before removal;
- a statement, under penalty of perjury, that you have a good-faith belief the material was removed by mistake or misidentification;
- your name, address and telephone number;
- a statement that you consent to the jurisdiction of the federal district court for your address (or, if you are outside the U.S., any judicial district in which MakeMeme may be found), and that you will accept service of process from the person who filed the original notice.
We'll forward the counter-notice to the person who sent the original notice. If they don't tell us within 10 business days that they have filed a court action, we may restore the material 10 to 14 business days after receiving your counter-notice.
5. Repeat infringers
We terminate, in appropriate circumstances, the accounts of users who are the subject of repeated valid infringement notices. Unused credits on accounts terminated under this policy are forfeited.
6. A video of you without your consent
The fastest route for anyone whose face was used without permission.
Our rules require consent from everyone who appears in an upload. If you believe someone used MakeMeme to make an image or video of you without your permission, or of your child, email [email protected] with the subject "Likeness report" and include:
- a link to the content, or a screenshot or copy of it;
- where you found it, if it was posted on another site;
- a way to confirm the content shows you, such as a photo of you (deleted after review).
If the content is on MakeMeme, we'll remove it. If it was made with MakeMeme and posted elsewhere, we'll investigate the account that made it, take action under our Terms, and provide what we reasonably can to support your report to that platform. We treat reports involving minors or sexual content as urgent.
7. Trademark complaints
Trend names on MakeMeme describe what people search for, and we state on each page that we are not affiliated with the brands involved. If you believe our use of your trademark is likely to confuse people, email [email protected] with the mark, its registration details, the URL and your concern. We review every request.
8. What happens next
- We acknowledge complete notices within 2 business days.
- We remove or disable access to material we determine is infringing promptly, usually within 2 business days.
- We tell the affected user, and give them a copy of the notice with your personal contact details removed where the law allows.
- We keep a record of notices for at least 3 years.
9. False notices
Under 17 U.S.C. § 512(f), anyone who knowingly and materially misrepresents that material is infringing, or that it was removed by mistake, may be liable for damages. Please check that the material is not covered by a licence or fair use before sending a notice. If you're unsure, consider getting legal advice.
